This Content Submission Upload Addendum supplements the terms of use on this site. Capitalized terms not defined herein shall have the meaning set forth in the terms of use on this site.
This addendum and the terms of use provide the terms and conditions that will govern your relationship with Microsoft regarding any materials (including logos, designs, or other creative) you submit to us on this site (“Submissionsâ€).
Microsoft does not claim ownership of the Submissions, except for any material in your Submission that we licensed to you. By uploading your Submission, you grant Microsoft all the necessary rights to make your Submission available on this site and other Microsoft sites, and in any advertising or marketing collateral, print or online, which markets those sites. These rights include granting Microsoft a free, worldwide license to:

use, copy, distribute, display, publish and modify your Submission, each in connection with the service;

publish your name, logo and photo (if provided as part of your Submission) in connection with your Submission; and
-
use, copy, distribute, display, and publish your Submission in advertising or marketing collateral, print or online, which markets this site and other Microsoft sites on which your Submission is made available.
We will not pay you for your Submission. We may refuse to publish and may remove your Submission from the service at any time.
If your Submission contains an add-on, that add-on must comply with the guidelines located here (http://support.microsoft.com/kb/973764).
You warrant and represent to Microsoft that:

For every Submission, you have all rights necessary for you to grant the permissions in this addendum.

Any information you provide about yourself or the Submission is complete and accurate.

Any person depicted in any images, photographs or other material contained in the Submission has provided consent to the depiction.

Your Submission does not violate or facilitate the violation of any rights of Microsoft or any third party arising under contract law, statute, or otherwise.

Your Submission does not contain any Prohibited Code. “Prohibited Code†means software code of any kind that (i) is potentially harmful to or could compromise a user’s system, software data, security or privacy; (ii) without the user’s express knowledge and consent, interferes with the operation of applications; (iii) launches or causes other similar code or applications similar to the foregoing to launch; (iv) is obscured or resistant to removal; (v) without the user’s express knowledge and consent, removes or disables security, anti-spyware or anti-virus technology; (vi) without the user’s express knowledge and consent, displays advertisements, unless they are promoting an alternative version of the software (e.g., an update or upsell); or (vii) without the user’s express knowledge and consent, collects or shares personal information, changes file associations, adds browser toolbars or changes browser settings such as the user’s favorites, default home page or search provider.

You will indemnify, defend and hold Microsoft and its affiliates harmless from any and all claims, demands, costs, liabilities, losses, expenses and damages (including attorneys’ fees, costs and expert witnesses’ fees) arising out of or in connection with any claim brought by a third party arising out of your Submission (excluding any material in your Submission that we licensed to you).
